By downloading, installing, or using the Connections application ("App"), these Terms & Conditions ("Terms") will automatically apply to you. You should ensure that you read them carefully before using the App.
If you do not agree to these Terms, you must not install or use the App.
The App itself, and all trademarks, copyrights, database rights, source code, and other intellectual property rights related to it, belong strictly to Malhotra Apps (Rahul Malhotra).
Malhotra Apps is committed to ensuring that the App is as useful and efficient as possible. We reserve the right to make changes to the App or to introduce charges for its services at any time and for any reason. We will never charge you for the App or its services without making it explicitly clear to you exactly what you are paying for.
The Connections App stores and processes personal contact data that you provide to us to deliver the Service. It is your sole responsibility to keep your device and access to the App secure.
We strongly recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. Rooting or jailbreaking could make your phone vulnerable to malware, viruses, and malicious programs, compromise your phone’s security features, and cause the Connections App to malfunction or cease working entirely.
The App utilizes third-party services that declare their own Terms and Conditions. Below are the links to the Terms and Conditions of third-party service providers used by the App:
Certain functions of the App require an active internet connection (Wi-Fi or mobile data). Malhotra Apps cannot take responsibility for the App not working at full functionality if you do not have access to Wi-Fi or have exhausted your mobile data allowance.
When using the App, it is important to bear in mind that although we endeavor to ensure the App is updated, secure, and correct at all times, we rely on third parties (such as Google Firebase) to process and store information.
Malhotra Apps and the Developer (Rahul Malhotra) accept NO liability for any loss, direct or indirect, data corruption, security breach, server downtime, or system failure you experience as a result of relying wholly or partially on the functionality of the App.
Please refer to Section 5 of our Privacy Policy for full details on our Disclaimer of Warranties and Limitation of Liability.
To the maximum extent permitted by applicable law, in no event shall the total aggregate liability of Malhotra Apps, the Developer (Rahul Malhotra), or their affiliates, agents, and licensors arising out of or relating to the App, services, or these Terms, under any and all legal theories (whether in contract, tort, negligence, strict liability, warranty, or otherwise), exceed ₹1 (One Indian Rupee) or the total amount actually paid by you (if any) to use the App in the twelve (12) months preceding the claim, whichever is lower.
You agree to defend, indemnify, and hold harmless Malhotra Apps, Rahul Malhotra, and their affiliates, officers, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your access to or use of the App; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any privacy right, data protection right, or intellectual property right; or (iv) any claim that your contact submissions or user content caused damage to a third party.
At some point, we may wish to update the App. The App is currently available on Android — the requirements for the system (and for any additional systems we decide to extend the availability of the App to) may change, and you will need to download updates if you want to keep using the App.
These Terms & Conditions and any disputes, controversies, or claims arising out of or relating to the App shall be governed by and construed in accordance with the substantive laws of India, without regard to its conflict of law principles. You expressly and irrevocably agree that the competent courts located in New Delhi, India shall have exclusive jurisdiction over any matter or dispute arising hereunder.
